A person convicted of a first time drug charge may have to serve as many as 20 years in prison. California's three strike law significantly lengthens a person's jail sentence. An individual who has two previous convictions and is convicted for a third crime could receive a life sentence.

According to the Controlled Substances Act, Title 18, Section 863, the penalty for selling, importing, exporting or mailing drug paraphernalia is incarceration for no longer than three years.

The Controlled Substance Act, Title 21, Section 844a, states that any person, who knowingly is in possession of certain controlled substances, including heroin and cocaine, cannot be fined more than $10,000 per violation. This law only applies to individuals who have no previous drug-related convictions.

Any person who has been convicted of a drug-related felony in California may be denied certain benefits and assistance. The Controlled Substance Act, Title 21, Section 862a, states these felons will not be eligible for food stamp services or Social Security benefits.
